GPA Power of Attorney
My father's name has been registered in the sub registrar office as general power of attorney holder of land.
He had purchased the land property by notarized stamp paper documents of one is sales agreement and another is power of attorney documents. But he registered himself as gpa (general power of attorney) in the the sub registrar office. Instead of owner by creating sale deed document. Because of his wrong business advisors.
Only after adding my father's name as the owner of the land. I can add my name as the owner. For this I need to obtain sale deed document which is missing from father's office. Or maybe this sale deed was never created by my father. Which must be created within 3 years of creating sales agreement notarized document.
Because my father's office consisting of documents was sold to another person by the bank. Vardaman bank of Mr. Bagi chairman. Who is owner of petrol pump in deshpande nagar hubli.
This must be obtained from those who have purchased from my father. Or from the sub registrar office.
My father passed away in June 2004. He was a proprietor and myself partner in Rainbow Constructions, builders and promoters. At that time he was into construction of appartments in (1) cotton market, (2) vijaynagar. While the (3) Deshpande nagar, dasara appartment, was already completed in 1998 (Hubli Karnataka).
Since after 2004 the buildings are not constructed any further. They are in the same half completed state. Buildings are in partially completed state. Thus these buildings much be completed and finished to provide justice to the investors.
He created the documents for purchased lands in cotton market and vijaynagar areas. (1) sale agreement and sale deed (2) general power of attorney agreement (GPA).
In the Hubli Karnataka city survey office, and tahsildar office documents, his name is mentioned as general power of attorney holder (GPA). Instead of owner.
It's a common routine procedure for builders and promoters to sell builtup area as GPA holders. Because it reduces the cost of the purchasers. And increase the profit margins.
My father had paid money to purchase the land for construction, the approximate amount paid for (1) cotton market land was 20 lacks, and (2) vijaynagar land was 15 lacks. Apart from this, he had also invested in construction (approximately 20 lacks each), and had also taken loans from banks. Hubli urban Bank and vardaman bank.
This GPA document was notarized, but I was not able to recover a copy from city survey office, and tahsildar office records. I think in the years of 1995, all the builders and promoters in Hubli constructed buildings as GPA power of attorney holders to save government fees. To reduce the cost of sales price. And to increase profit.
All the original documents of all business dealings are missing. For example: (1) sale agreements, (2) power of attorney agreements, (3) sale deeds of sold shops and flats. As the office which consisted of these documents was sold to another person by the vardaman bank, from which my father had taken loan after hypothecation of this office shops.
Before death my father had rented his office to finance company mr kotresh wartak who had the office keys. Where the missing documents were kept.
After the death of my father. The bank named as (1) Hubli urban Bank, has sold the second and third floor of "Kay kay complex, cotton market" to individual person, Gopalkrishna gujjadi, Swarna jewellers, to recover the loan amount. And the office shops which were in my name was sold to individual person by bank name (2) vardhaman bank Hubli. To recover the loan amount.
I need to investigate if my father had invested in the petrol pump of Mr. Shital Bagi, in Deshpande nagar Hubli. As he was previously the chairman of vardhaman bank in Hubli.
He had created the ownership documents as sale agreement in his name (rainbow constructions) for the purchased land. But in the city survey office, he registered the document (1) "GPA power of attorney", and he did not register the document (2) "sale agreement", and "sale deed". This is because, i think probably to reduce expenses, as registering "sale agreement" was more expensive compared to "GPA" documents. To save money.
I am searching for sale deed and ownership documents to transfer my father's name into his family members name.
I need to investigate how much is the pending arrears money to be recovered by those who have purchased from my father.
Because usually construction and sales would complete in few years. Father thought "GPA" was sufficient enough to sell the constructed building.
According to law, if I am correct, GPA will end along with the demise (expiry) of the GPA holder. Or if the demise of the owner. It's not transferred in my name (his son) or family members name.
I need to get sale deed to register the name of my father as owner.
After the demise of the GPA holder the authority of land goes back to the previous owner of the land.
I need to create a new gpa (or sale agreement) in my name given by the previous landlord owner.
I need to investigate.
@. If the previous landlord owner has sold our constructed building which we had invested. After the demise of father since 2004.
@. How much square feet area was not sold by father. Which was remaining unsold by father.
@. Recover the amount from the new owner for the remaining unsold property which was constructed by father upto ground floor plus first, second and third floors plan which was approved for construction by father.
I need to obtain a photocopy of these documents from the previous owners. As all the documents in the previous office of my father in 2004 are missing. As this office shop premises was sold to another person by bank.
I need to investigate, how much is outstanding, amount to be recovered from sold shops and flats. How much is the received and pending balance amount for sold shops and flats.
I think it's not fair and justice for the owner to sell the building which was constructed by the expired GPA holder.
The financial transactions need to be clearly analysed and justice must be done by giving the financial benifit to the expired GPA holders family.
The first residential appartment that was constructed by father in 1999 was in Deshpande nagar, this land was ownership of my grandfather.
Thus legally I have the rights of inheritance (warsa) to construct building on the fourth floor of the appartment. As this was ground plus three floors, before in 2004. I need to process the documentation for this.

From 1996 to 2021
After completing my B-Tech in BVB Hubli in 1996. I worked in civil engineering constructions until 2000.
After that I switched to software from Bangalore in 2000 until 2009.
While I was in Bangalore, working in software.
In the year 2004 my father passed away suddenly. Due to heart-attack. He had a loss in his business. Due to bankruptcy. He had lost his health and balance due to excessive alcohol.
After my father passed away in 2004. My mother secretly robbed my father's wealth. She lied to me that she did not have any money. My mother did this along with the help of my sister. And her sisters and brothers. So all of them are against me because of my mother hiding secret from me. I came to know about this in 2024.
Before this. In the year 1998 my father had refused to handover his business authority to me.
He said that he would handover the authority to his wife, my mother.
As my mother desired control over the business wealth.
He told me to earn my own wealth. To attain my financial stability.
I had requested to take control as I could see loss in business due to father's decisions.
When I was not with my father he underwent severe loss in business. As people around him misguided my father. As i was not there arround to know the manipulation.
When I was in my thirties I did not inherent any ancestral property or financial benefits from my parents.
After my father passed away my mother wanted me to marry. And control me. But I did not marry as I was financially weaker. I have written here.

Thus I didn’t inherent anything from my parents.
In 2005 I went to USA with a hope to achieve financial stability. But it did not work. I returned back to India in 2009. As I faced legal problems due to immigration laws.
As things were not working out. In india I visited Himalayas in 2010. On a spiritual pilgrimage. For healing of body and mind. Seeking to find answers to my problems. Seeking for positivity and to find new hope. Seeking for solutions to live a happy life. As I was single then. And still single, due to financial instability.
I could see that. All the good marriage proposals were available only for financially stronger and well established men.
In Himalayas. Shimla Himachal Pradesh. As it was greener, colder, with cleaner air. With lower pollution, lesser dust and mosquitoes. I thought of living there until I find a new solution to my life. Trying to find answers for a better way of path, to live a better life.

After all this. It was not possible to achieve financial strength and stability. I could not purchase land.
I have written here regarding lower income problems.
As I was finding difficult to get good job opportunities. I thought of doing M-Tech. To get better income. I completed M-Tech in 2019.

In 2019. I started trying for PHD. Research stipend. In Germany as it’s less expensive.
In 2020. I told about this to one of my friend, an attorney in shimla, whom I knew past 7 years.
He completely agreed to my situation.
He promised to help me.
As he expressed sympathy for my situation.
He promised to provide me with a Canada visa. Work permit.
As he said he was a Canadian PR.
But after taking money from me. He betrayed me.
This Advocate. Mr. Kunal Sharma.
He is supposed to provide justice to others by profession. But he is doing injustice himself.
Such people are a curse to this great nation. Justice system is critical for a better nation. Providing law and order to citizens.

Since covid lockdown. Since 2020. My savings have reduced. Paying house rental, living expenses. Without any income. Economy slowdown.
In 2021. I thought of purchasing a small piece of farmland. At a cheaper price. On a bank loan. To eliminate paying for house rent. To reduce living expenses. I am still trying.
People ask me why I wish to live in a village farmland. Fear comes when we don't know the solution to the problems of our life. Life can be simple if we can take care of our BODY and MIND. Loving oneself is the first step towards healing.

My age of thirties.
In my childhood, in my age of tens, I was afraid of my parents. I grew up with fear and obedience to my parents.
In my age of twenties, in my college days, my father restricted giving me financial support.
When I was in my thirties I did not inherent any ancestral property or financial benefits from my parents.
After my father passed away my mother wanted me to marry, but I did not marry as I was financially weaker.
Since my age of thirties, I have been seeking for financial stability.
My father passed away in the year 2004 due to heartattack. As he was drinking alcohol much over the limit. Thus he had become weaker.
Before my father passed away, when I was in my thirties. In the year 2000. My father told me that he would transfer all his property and finances to his wife, my mother. This is because. My mother requested my father, to transfer his property and business to her name. So that she could be self-sufficient and independent living on her own. So that she would not be dependent on others. My father was also favorable to my sister. She was aware, knew about this.
Thus my father told me to earn my wealth on my own. By living independent. To become self-sufficient. He did not disclose anything about his business transactions and financial assets to me.
After he stayed away from me. His business declined, underwent loss, mismanagement and became weaker. Consequences of staying away from me. Removing me from his business.
At that time I had requested my father not to do so, because my mother was not capable of handling the business, or financials.
After my father passed away my mother told me that she had not received any financials and property from my father.
Thus in my age of thirties, I was trying to purchase property and create financial stability for myself.
It was not possible to achieve financial strength while I was in USA.
After returning back from USA in the year 2009. I went to Himalayan region on a spiritual pilgrimage, to visit places like, Haridwar, Badrinath, Vaishnodevi, Shimla. In the states of Himachal Pradesh and Uttarakhand.

Father's friends
My father was an pleasure seeking person. He extracted pleasure from wine, liquor, meat, fish and women and men's company of his similar type.
He admired those men and women who praised him and admired and respected his wrong addictions and his personality.
He became happy with those who called him generous with respect. His friends who were similar like him used to praise him and he used to spend money on them. And he used to listen to his admirers who praised him. And his friends had an intention to extract benefit and their own selfish wicked advantage of liquor, meat and lavish addictions.
Many of his disciplined friends who did not have bad addictions took advantage of his weakness by making false promises. All together they took advantage of his intoxicated state of happy mind. Which was a disaster to me. As he listened to his business advisors misguidance.
He married his wife because she was good looking, beautiful and his relatives and parents arranged his marriage. His wife and my mother married him admiring his wealth and money, eventhough even though he had bad addictions and habits. She ignored his bad addictions and habits. Because her elder brother and her relatives already knew about my fathers bad addictions before marriage. But they also knew he was a wealthy man.
After marriage my mother used to quarrel and fight with him for his addictions. This made his mind even worse because of her behavior tactics. She made severe efforts to control his lifestyle which destroyed the relationship.
One of my father’s friends revealed about my father giving money to my mother after several years of my father’s death in 2021. Because my father had discussed about this to his friend before his death. According to my father's friend.
Before my father passed away he has taken loans from banks and other financial services, after that he has transferred all the money into my mother’s bank account. After that he passed away. My mother told me that she cannot give me any money. She told me earn my own living.
He was into real-estate building construction business with wrongly registered notary stamp paper documents as an power of attorney holder instead of owner of the purchased land.
After my father's death, banks, ( financial services ), seized, and overtook the hypothecated property of my father and recovered the money by selling it to others.
After my father’s death, my mother lied saying that she has not received any money from my father. She then started to prove to everyone that she is having no money. She then Started crying in front of her brother’s, and others, saying that she doesn’t have money and she started taking money from them. Her brother’s must know the truth so that they will not be fooled by her.
My mother tells lies and makes false drama. She hides the truth. She is dominating. She wants her son to be her slave. She wants to control her son, by not giving him money of his father. She wants to control by keeping the money. My mother is manipulative, not a truthful, not humble person. She becomes arrogant to achieve her selfish objectives.

Property inheritance
My mother always tried to mould my future in such a way which would benefit herself. I didn't understand in my childhood. but slowly understood as I grew up slowly. But I always tried to mould my future according to my own happiness. But I think, I am a good man. I have good intentions.
In my thirties. My mother tried to find me a girl which would be beneficial to herself. She did not give me financial strength to inherit ancestral property. She assumed that, she would lose her financial power by giving me her financial power, which was my ancestral wealth.
Her priority was to protect herself, quite natural. But it was an obstacle to my own future. But she neglected my future security. When ever she is enquired, questioned. She starts to cry, shead tears, shows her helplessness. She has no intention to help. Saying she has no power to help me. She puts conditions, that if I listen to her, then maybe my future will be better. Blackmailing.
My parents were afraid to give me financial power. They falsely assumed that it would be wrong to give me power. As they misunderstood that they would become my slaves. As they would lose their power to dominate, and to control me.
When I was studying in my college in 1995 my father had told me not to expect any financial help from him. He had told me that he would not provide me any financial help as he had also created his life on his own. Which was not true as he had inherited my grandfather’s house and land. He had told me that I must create my life without his support. He had told me that I had to be a self made man, to live my independent life with my own efforts. My father used to spend money on unnecessary things.
I remember my father had told me approximately in the year 2000, that he had decided to transfer all his family property and financials to his wife (my mother). At that time I had told him not to do so. As it would create a lack of management due to insufficient business experience of his wife (my mother). I thought my mother was not capable to handle business management and financial management, as she didn't have experience in business management.
I think he might have requested some close relatives to help assist his wife (my mother) after his demise. I am not sure about the identity of this person, but I am doubtful it might have been my mother’s brother (doctor LS Kulkarni), or might be the husband of my mother’s sister shamala (DRB Desai). I am not sure about it.
I have a doubtful wonder as to what would have happened, if he had given his wife cash currency, in the time of demonetization by the Indian government.
After my father’s demise, My mother’s brother (doctor LS Kulkarni) had told me in 2004 and in 2009 not to stay in city Hubli as it might hurt me due to my father’s financial loans. I don’t know why my mother’s brother (pharmacist prakash s kulkarni) also had told me the same in the year 2020. The same thing was also said by Engineer (DRB Desai) also in 2004 and in 2009.
My relative's told me that my sister has deposited money into my mother’s bank account. I feel this is a lie. I think if my sister wanted to help my mother financially then she could have paid for mother’s expenses monthly instead of depositing money into mother’s bank account. I think, not sure, that my mother inherited financial or property support from my father which was not revealed to me after his death. I think, to hide this my mother has taken my sister’s help.
